2. Cos'è PokerWinnings

PokerWinnings è un'app per registrare e analizzare i risultati delle tue sessioni di poker (Cash Game e tornei), live e online, e calcolare statistiche e grafici.

PokerWinnings is an app to record and analyse the results of your poker sessions (Cash Game and tournaments), live and online, and to calculate statistics and charts.

• Non è un servizio di gioco d'azzardo: con l'app non si gioca, non si scommette e non si vincono o trasferiscono soldi.
• Non è collegata ad alcuna room o casinò. I nomi di room e luoghi che inserisci appartengono ai rispettivi proprietari e non indicano alcuna collaborazione o approvazione.
• Non è consulenza finanziaria, fiscale o legale. Statistiche e conversioni di valuta sono indicative e dipendono dai dati che inserisci tu.

• It is not a gambling service: you cannot play, bet, or win or transfer money in the app.
• It is not affiliated with any poker room or casino. The names of rooms and places you enter belong to their owners and do not imply any partnership or endorsement.
• It is not financial, tax or legal advice. Statistics and currency conversions are indicative and depend on the data you enter.

3. Who can use it

Devi avere almeno 18 anni, o l'età maggiore prevista nel tuo Paese, e poter accettare un contratto vincolante. Sei responsabile di rispettare le leggi sul gioco del luogo in cui giochi: l'app serve solo a tenere traccia dei risultati.

You must be at least 18, or the higher age of majority in your country, and able to enter into a binding contract. You are responsible for complying with the gambling laws where you play: the app only keeps track of results.

• Per usare l'app serve un account con un indirizzo email valido. L'account è personale: non condividerlo.
• Tieni al sicuro la password. Se pensi che qualcuno abbia accesso al tuo account, cambiala e scrivici.
• Puoi eliminare l'account in qualsiasi momento da Profilo → Elimina account. Se hai un abbonamento, eliminare l'account non lo disdice: va disdetto nello store (vedi punto 6).

• You need an account with a valid email address to use the app. The account is personal: do not share it.
• Keep your password safe. If you think someone has access to your account, change it and write to us.
• You can delete your account at any time from Profile → Delete account. If you have a subscription, deleting the account does not cancel it: cancel it in the store (see section 6).

La versione gratuita include le funzioni principali e mostra pubblicità. L'abbonamento PRO toglie la pubblicità e sblocca funzioni aggiuntive (per esempio filtri avanzati, statistiche dettagliate e record, confronto tra periodi), come descritto nella schermata PRO dell'app. Possiamo migliorare, modificare o aggiungere funzioni nel tempo; se togliamo una funzione PRO importante durante il tuo abbonamento, te lo comunichiamo in anticipo.

The free version includes the main features and shows ads. The PRO subscription removes ads and unlocks extra features (for example advanced filters, detailed statistics and records, comparing periods), as described on the PRO screen in the app. We may improve, change or add features over time; if we remove an important PRO feature during your subscription, we will tell you in advance.

A volte possiamo offrire PRO gratuitamente (per esempio a tester o in promozioni). Il PRO gratuito non è un abbonamento a pagamento e può avere una scadenza.

We may sometimes offer PRO for free (for example to testers or in promotions). Complimentary PRO is not a paid subscription and may have an expiry date.

6. Abbonamenti, prova gratuita e pagamenti

6. Subscriptions, free trial and payments

• Chi incassa: l'abbonamento si acquista dentro l'app e il pagamento è gestito da Google Play o dall'App Store di Apple, con il metodo di pagamento del tuo account. Si applicano anche i loro termini.
• Piani e prezzi: mensile o annuale. Il prezzo è quello mostrato nell'app e nello store prima della conferma, tasse incluse dove previsto, e può variare da paese a paese.
• Rinnovo automatico: l'abbonamento si rinnova automaticamente alla fine di ogni periodo, allo stesso prezzo, finché non lo disdici. L'addebito avviene al momento del rinnovo.
• Prova gratuita: se offerta (per esempio 7 giorni sul piano annuale), è riservata a chi non ha mai avuto l'abbonamento. Se non disdici prima della fine della prova, l'abbonamento parte e il primo periodo viene addebitato.
• Disdetta: puoi disdire quando vuoi nelle impostazioni dello store (Google Play: Play Store → Pagamenti e abbonamenti → Abbonamenti; iPhone: Impostazioni → il tuo nome → Abbonamenti). Per evitare il rinnovo, disdici almeno 24 ore prima della fine del periodo. Dopo la disdetta mantieni PRO fino alla fine del periodo già pagato.
• Cambi di prezzo: se aumentiamo il prezzo, lo store te lo comunica in anticipo e, quando la legge o lo store lo richiedono, ti chiede di accettarlo. Se non lo accetti, l'abbonamento non si rinnova.
• Rimborsi: sono gestiti da Google o Apple secondo le loro regole (per Google Play puoi chiederlo da play.google.com, per Apple da reportaproblem.apple.com). Se hai problemi, scrivici e ti aiutiamo.

• Who charges you: the subscription is bought in the app and payment is handled by Google Play or Apple's App Store, using the payment method of your account. Their terms also apply.
• Plans and prices: monthly or annual. The price is the one shown in the app and in the store before you confirm, taxes included where applicable, and may vary by country.
• Automatic renewal: the subscription renews automatically at the end of each period, at the same price, until you cancel it. You are charged at renewal.
• Free trial: when offered (for example 7 days on the annual plan), it is only for people who never had the subscription. If you do not cancel before the trial ends, the subscription starts and the first period is charged.
• Cancelling: you can cancel at any time in the store settings (Google Play: Play Store → Payments & subscriptions → Subscriptions; iPhone: Settings → your name → Subscriptions). To avoid renewal, cancel at least 24 hours before the end of the period. After cancelling you keep PRO until the end of the period already paid.
• Price changes: if we raise the price, the store tells you in advance and, where the law or the store requires it, asks you to accept it. If you do not accept, the subscription does not renew.
• Refunds: handled by Google or Apple under their rules (for Google Play you can request one at play.google.com, for Apple at reportaproblem.apple.com). If you have problems, write to us and we will help.

Diritto di recesso (consumatori UE): PRO è un contenuto digitale fornito subito dopo l'acquisto. Confermando l'acquisto chiedi che il servizio inizi immediatamente e prendi atto che, una volta iniziato, perdi il diritto di recesso di 14 giorni, nei limiti previsti dalla legge. Durante una prova gratuita non paghi nulla e puoi disdire in qualsiasi momento. Restano sempre salvi i tuoi diritti di legge, per esempio se il servizio non funziona come descritto.

Right of withdrawal (EU consumers): PRO is digital content supplied immediately after purchase. By confirming the purchase you ask for the service to start immediately and acknowledge that, once it has started, you lose the 14-day right of withdrawal, to the extent the law allows. During a free trial you pay nothing and can cancel at any time. Your statutory rights always remain, for example if the service does not work as described.

Quello che inserisci (sessioni, note, luoghi, foto) resta tuo. Ci concedi solo il permesso di conservarlo ed elaborarlo per fornirti il servizio (per esempio salvarlo, calcolare le statistiche, mostrarti le foto). Puoi esportare i tuoi dati in qualsiasi momento (Profilo → Esporta i miei dati) e cancellarli.

What you enter (sessions, notes, places, photos) remains yours. You only grant us permission to store and process it to provide the service (for example saving it, calculating statistics, showing you your photos). You can export your data at any time (Profile → Export my data) and delete it.

Sei responsabile di ciò che carichi: non inserire contenuti illegali, offensivi, che violano diritti altrui (per esempio foto di cui non hai i diritti) o dati personali di altre persone senza il loro permesso.

You are responsible for what you upload: do not add content that is illegal, offensive, infringes others' rights (for example photos you have no rights to) or personal data of other people without their permission.

Ti consigliamo di esportare ogni tanto i tuoi dati: facciamo il possibile per non perderli mai, ma nessun sistema è infallibile.

We recommend exporting your data from time to time: we do our best never to lose it, but no system is infallible.

8. Uso corretto

8. Acceptable use

Non puoi: usare l'app per scopi illegali; tentare di accedere ai dati di altri utenti o ai nostri sistemi; copiare, decompilare o modificare l'app salvo quanto consentito dalla legge; aggirare il blocco delle funzioni PRO o i limiti tecnici; sovraccaricare il servizio con mezzi automatici; rivendere o mettere a disposizione di terzi l'app o l'abbonamento.

You may not: use the app for illegal purposes; try to access other users' data or our systems; copy, decompile or modify the app except as permitted by law; bypass the PRO feature lock or technical limits; overload the service by automated means; resell the app or the subscription or make them available to third parties.

9. Proprietà intellettuale

L'app, il nome e il logo PokerWinnings, la grafica e il codice appartengono a noi o ai nostri licenziatari. Ti concediamo una licenza personale, non esclusiva e non trasferibile per usare l'app sui tuoi dispositivi, nel rispetto di questi termini e delle regole dello store da cui l'hai scaricata.

The app, the PokerWinnings name and logo, the design and the code belong to us or our licensors. We grant you a personal, non-exclusive, non-transferable licence to use the app on your devices, in line with these terms and the rules of the store you downloaded it from.

10. Disponibilità, sospensione e chiusura

10. Availability, suspension and termination

Facciamo il possibile perché il servizio sia sempre disponibile, ma possono esserci interruzioni per manutenzione, aggiornamenti o problemi dei fornitori. Possiamo sospendere o chiudere un account che viola gravemente questi termini, di norma dopo averti avvisato e dato modo di rispondere. Se un giorno decidessimo di chiudere il servizio, ti avviseremo con almeno 30 giorni di anticipo, così potrai esportare i tuoi dati, e non rinnoveremo più gli abbonamenti.

We do our best to keep the service always available, but there may be interruptions for maintenance, updates or provider issues. We may suspend or close an account that seriously breaches these terms, normally after warning you and giving you a chance to respond. If we ever decide to shut down the service, we will give you at least 30 days' notice, so you can export your data, and subscriptions will no longer renew.

11. Responsabilità

Forniamo l'app con cura, ma non possiamo garantire che sia sempre priva di errori. Statistiche, totali e conversioni di valuta dipendono dai dati inseriti e da fonti esterne (tassi di cambio): verificali prima di usarli per decisioni importanti o dichiarazioni fiscali.

We provide the app with care, but cannot guarantee it is always error-free. Statistics, totals and currency conversions depend on the data entered and on external sources (exchange rates): check them before using them for important decisions or tax returns.

Nei limiti consentiti dalla legge, non rispondiamo di danni indiretti né di perdite di gioco, e la nostra responsabilità complessiva è limitata all'importo che hai pagato per PRO nei 12 mesi precedenti. Queste limitazioni non si applicano in caso di dolo o colpa grave, danni alla persona, né limitano i diritti che la legge riconosce ai consumatori.

To the extent permitted by law, we are not liable for indirect damages or for gambling losses, and our total liability is limited to the amount you paid for PRO in the previous 12 months. These limitations do not apply in case of wilful misconduct or gross negligence or personal injury, and do not limit the rights the law grants to consumers.

12. Modifiche ai termini

12. Changes to these terms

Possiamo aggiornare questi termini, per esempio per nuove funzioni o cambi di legge. Se le modifiche sono importanti, ti avviseremo nell'app o via email almeno 30 giorni prima. Se non le accetti, puoi disdire l'abbonamento ed eliminare l'account; continuando a usare l'app dopo l'entrata in vigore le accetti.

We may update these terms, for example for new features or changes in the law. If the changes are significant, we will notify you in the app or by email at least 30 days in advance. If you do not accept them, you can cancel your subscription and delete your account; by continuing to use the app after they take effect you accept them.

13. Legge applicabile e controversie

13. Governing law and disputes

Questi termini sono regolati dalla legge maltese. Se sei un consumatore, mantieni comunque la protezione delle norme inderogabili del Paese in cui vivi e puoi rivolgerti ai tribunali di quel Paese. Prima di tutto, però, scrivici: cerchiamo sempre di risolvere ogni problema in modo amichevole.

These terms are governed by Maltese law. If you are a consumer, you still keep the protection of the mandatory rules of the country where you live and may bring proceedings before the courts of that country. First of all, though, write to us: we always try to solve any problem amicably.
